I, William Howard of Moniteau County,
Missouri, being of sound mind do make and publish this my last will and
testament as follows.
1st To my son William David Howard I give two thousand
dollars.
2nd To my daughter, Nancy L., wife of Presly Moore, I give two
thousand dollars.
3rd To my son, Nicholas P. Howard, I give the following lands in
Moniteau County, to wit: the west half of the south west quarter, All the
south west quarter of the south east quarter except a strip off the south
end belonging to C. Hadel; Also that part part of the north west quarter
of the south east quarter that lies south of the centre? of the county
road running north and south through said tract. All in section six
(6) Township forty five (45) range fifteen (15). I value these lands at
two thousand dollars.
4th To my daughter, Mary M. Toler, wife of H.T. Toler, I give the
following lands in Moniteau County. The south west quarter of the
north east quarter and that part of the north west quarter of the south
east quarter that lies north of the centre of the county road running
north and south through said tracts All in section six township forty five
(45) range fifteen (15) which lands I value at two thousand dollars.
5th To my grandchildren, Herman E. Howard and Flora J. Howard,
children of my son, John B. Howard, I give the east half of the south east
quaarter of section six (6) Township forty five (45) range 15 in Moniteau
County except one half acre used for school house, so long as used for
that purpose; Also except the land used for a grave yard. This
devise and bequest to my said grandchildren and the land therein desonbul??
is charged with the support and maintenance of my said son John B. Howard
during his life.
6th All the remainder of my estate real and personal I bequeath to
my son William D. Howard and my son-in-law, Presly Moore who are
appointed exedutors of this will, who as such executors shall have power
to sell and convey all my real estate , not herein devised, and convert
all my remaining estate into money, out of which they shall first pay the
legacies herein mentioned and the remainder they shall divide equally my
five children above mentioned, except that the share coming to my son,
John B. Howard shall be paid to his legal guardian for his use and
benefit.
7th I desire that the specific legacies herein mentioned be paid
within one year after my death. Witness my the this September 24th
1901.

the request and in the presence of the above testator this September 24th
1901.

I hereby add this codicil to the above will
so as to modify the 6th item of clause therein which I now change as
follows: The land bequeathed to my son John B. Howard and his
children Herman E. and Flora J. Howard shall be in full of all interest my
said son John and his children shall have in my estate and the residue of
my estate provided for in 6th clause above, when collected by the
execators therein named shall be divided between my four children viz:
William D. Howard, Nicholas P. Howard, Nancy L. Moore and Mary M. Toler,
share and share alike. In all other matters the above will is approved and
confirmed.
